Brett Michaels Suing CBS for 2009 Accident at Tonys

"The bandanna-rockin' Bret Michaels filed a lawsuit Friday against CBS and the Tony Awards for a head injury he sustained during a Tonys performance in June 2009. . . . . . . (Click on "read more" below)



The reality TV lover boy and Poison frontman says in the suit that he was never instructed there would be moving set pieces. After singing "Nothing But a Good Time," he was hit in the head by a piece of the stage and hospitalized for a broken nose and cut lip, people.com reports.
The suit, which is seeking unspecified damages, links the Tonys injury with Michaels' much-publicized subarachnoid hemorrhage, which occurred less than two weeks after he underwent an emergency appendectomy in April 2010.
"They must be held accountable for almost killing Bret, and that is what we are going to do," Michaels' attorney Alex Weingarten said. Thus far there has been no response from CBS or the Tonys to Michaels' claims."
My questions: 
So does this need to be a lawsuit? Or, could this be settled through mediation? 
Why now, when this happened 2 years ago? 
One thing to remember is that mediation is a process that can repair, rebuild, restore and help to maintain relationships. 
In this case, I am wondering which of the parties to this suit needs the other the most? Is this a case of biting the hand that feeds you?

  1. I think that Brett Michaels needs money since he didn't get the American Idol gig. Therefore, he is suing. It's like any battle...you come out with the big guns but then might have to back away. Of course mediation could settle this easily and there should be a settlement. However, publicity, bad or good, keeps a "stars" name in front of the public which is the goal of this lawsuit.
